These Terms and Conditions establish the rights and obligations of all users and customers (hereafter referred to as customers) and those of NAUPLIA CAPITAL GIJON S.L. with Tax ID Number B85984961 (hereafter referred to as PDG) in relation to browsing the website, acquiring User status, rights and obligations associated with such status, as well as commercial transactions and the use of services listed therein.
By using this website, you are bound by these Terms and Conditions, Privacy Policy, and Legal Notice, therefore we recommend that you read these Terms and Conditions carefully. If you do not agree with them, you should not use the website.

Applicable regulations
These General Terms and Conditions are subject to the provisions of Law 7/1998, of April 13, on General Terms and Conditions of Contract, Law 26/1984, of July 19, General Law for the Protection of Consumers and Users, and Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on Retail Trade Regulation, and Law 34/2002, of July 11, on Services of the Society of Information and Electronic Commerce (Servicios de la Sociedad de la Información y Comercio Electrónico)

Two services are marketed on the puertodeportivogijon.es website:
- Boat reservations.
- Mooring reservations.
The characteristics of the boats shown on the website are as follows:
- Name.
- Description.
- Technical characteristics.
- Rental options.
- Photographs.
The prices and services offered are valid as long as they are displayed on the website www.puertodeportivogijon.es and always subject to availability.
If an error is detected in the price or characteristics published for a service after an order has been placed, puertodeportivogijon.es will notify the customer and reserve the right to cancel the order for that service. The customer will receive a full or partial refund for their order.

The process for reserving boats and moorings is very easy and intuitive, but if you have any questions, just follow these simple steps.
BOATS
- The boat reservation process takes place on the website https://puertodeportivogijon.es/es/alquiler-embarcaciones-tarifas-barcos
- Fill out the form found on that page and select the boat, date, and number of hours. Fill in your contact details as well.
- After receiving your request, we will check availability and email or call you. Your reservation is only considered to be confirmed once you have been contacted by us.
- You must arrive 15-20 minutes before the given time in order to make payment and pay your deposit before you can use your boat.
Reservations are not accepted more than one week in advance, as weather and sea conditions cannot be predicted so far ahead of time.
Once the reservation form has been sent, Gijón Marina will contact you to finalize the details of your reservation, which will then be formalized by bank transfer.
MOORING RESERVATION
- The mooring reservation process, also known as online check-in, takes place on the website http://amarres-pdgijon.sailti.com/
- The following steps must be completed to confirm your reservation:
- SEARCH: select type of berth and boat, and the length, beam, and draft, as well as your arrival and departure dates.
- DETAILS: fill in other boat details (name, registration number, flag and list) and your personal and billing information.
- CONFIRM: your reservation details will be displayed for you to confirm.
- PAY: fill in your credit or debit card details (card you will use to pay for the reservation).
- FINISH: your booking confirmation and details will be displayed on the screen.
- 100% of the mooring cost will be charged during this process.
Once payment has been made, you will receive an email with your order details, informing you that your order is being processed. If you do not receive the email, check your SPAM folder.
Estimated rate based on the measurements provided. You will be billed according to the actual measurements of your boat as stated on official boat documentation.

Online check-in reservation process
You must complete the online check-in process to confirm all the details of the boat, captain, and passengers. To access the system, use your email address and the reservation code provided to you at the time of confirmation.
Information you must provide on the online check-in form:
- Owner: name, surname, ID Card/Passport number, telephone number, address, postcode, town, province, and country. Attach a photo of your ID document (front and back).
- Boat: complete technical details (name, registration number, flag, type of boat, list, length), boat insurance receipt (image), maritime registration (image), navigation certificate (image).
- Captain: name, surname, ID Card/Passport number, telephone number, address, postcode, town, province, and country.
- Origin/destination: point of origin and destination.
- Crew – provide the following for each crew member: name, surname, ID Card/Passport number, telephone number, address, postcode, town, province, and country. Attach a photo of each crew member’s ID document (front and back).
Payment methods
Payment will be made during the last step of your purchase. After you validate your delivery and billing address, we will show your purchase summary again so that you can check all details and the final price.

As explained below, payment can be made by bank card (credit or debit).
Payment by bank card
To pay by bank card, click on “SECURE PAYMENT BY BANK CARD” and you will be redirected to the Redsys secure online payment gateway where you must enter your card number, expiry date and CSV code. Finally, confirm your order by clicking on the “Confirm” button.
Once the transaction is complete, you will see a message confirming your payment and a button to return to the online store.
Cancellation of boat reservations
A recreational boat reservation may be cancelled in the event of adverse weather conditions. In this case, the customer will receive a refund for the amount of the reservation.
If the customer cancels a recreational boat reservation for reasons of force majeure, Gijón Marina will not refund the amount of the reservation; however, the customer may use the reservation at any time within one year, subject to availability.
Changes to the general terms and conditions of sale
The Owner reserves the right to modify these general terms and conditions of sale to adapt them to new legislation or case law, as well as to industry practices. These policies will remain effective until they are modified by others which are duly published.
Conflict resolution
The European Commission offers a platform for alternative dispute resolution in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council of May 22, 2013, for the resolution of online consumer disputes.
